Comprehensive Legal Support for NFA Firearms
FFLGuard’s NFA Yearly Service Plan offers specialized legal guidance for National Firearms Act regulations and compliance. Available as an add-on to FFLGuard’s tiered service plans, the NFA service allows users to access additional flat-fee legal representation specifically concerning their Class III items.
FFLGuard’s Support for NFA Transactions
Within the scope of your engagement, FFLGuard provides National Coordinating Counsel (NCC) support without additional NCC fees for two approaches: transactions that follow the established NFA process, and qualifying suppressor transfers from your FFL to an individual whose protection under the Silencer Shop injunction is documented using FFLGuard’s checklist. The suppressor exception does not cover transfers to trusts.
Transactions relying broadly on ATF’s nationwide nonenforcement policy fall outside this no-additional-fee NCC support. Criminal defense is excluded from this commitment under either approach and must be arranged and funded separately. Contact FFLGuard to confirm which procedures and services apply to your transaction.

FAQs
First passed in 1934, the National Firearms Act (NFA) imposes taxes and registration requirements on certain firearms. Since January 1, 2026, the making and transfer taxes on suppressors, short-barreled rifles, short-barreled shotguns, and any other weapons (AOWs) have been $0. Under ATF’s October 9, 2026 guidance, ATF will not enforce prior approval, registration, tax-stamp, and related NFA requirements for these items.
Machine guns and destructive devices remain subject to the $200 making and transfer taxes and all applicable NFA requirements. The NFA has not been repealed, special occupational taxes still apply to businesses importing, manufacturing, or dealing in NFA firearms, and state and local restrictions remain applicable. ATF continues to process submitted NFA applications.
Guns that are NFA controlled include:
- Machine guns
- Short barreled rifles
- Short barreled shotguns
- Silencers
- Destructive devices
- Machine gun frames or receivers
- Conversion kits for machine guns
- Grenades
- Any other weapon (AOW): pen guns, cane guns, etc.
Under federal law, the act does not allow prohibited persons to ship, transport, receive, or possess a firearm.
Prohibited persons include:

- Fugitives from Justice
