1.) FreshStart ($1,495) – Current Federal Firearms Licensees can take advantage of FFLGuard‘s cost-effective FreshStart Service to reorganize an existing firearms business, better ensuring the viability of their business.
* Entity Selection Advice – FFLGuard will advise you with regard to forming and operating as a corporate entity (such as a limited liability company or corporation), in order to negate potential personal liability (injury claims, contracts, debts, etc.) and help insure your business’ viability/continuity, FFLGuard counsel will also oversee the entire ATF application process and advise against pitfalls that could delay issuance of the FFL, while keeping track of your application at ATF’s Federal Firearms Licensing Center in Martinsburg, WV.
* Basic General Startup Advise – FFLGuard counsel will advise you on general matters regarding the startup of a new business, such as creating new accounts, new company identities, etc.
Optional FreshStart Services #1 – Attendance During Application Inspection – FFLGuard counsel will travel to your store, meet with you to prepare for the ATF’s application inspection, and attend that inspection to help you answer and address ATF questions regarding your reorganized business and future plans.
Optional FreshStart Services #2 – Consultation with Local Counsel Re: Transaction – FFLGuard will work with your local counsel to prepare an agreement and other documents necessary to implement the previously prepared Transaction Plan. The agreement and other documents will often require firearms-specific provisions that FFLGuard is particularly qualified to prepare.
2.) JumpStart ($3,995) offers all of the FreshStart services to potential FFLs. To start, FFLGuard will assist you with completing and submitting your FFL Application (Form 7) and the fee doesn’t recur until one year after issuance of the FFL.
3.) Public Relations (PR) Program – When your name, business, and integrity are at state, we refer you to our PR Professionals to handle any media crisis with minimal damage to your reputation and future.
4.) RecordSentinal – Our professionals will perform a random-sample quality check of your A&D Book and completed 4473s. After our review, a report is generated to indicate what issues may exist. From there, we highlight what is required by law, as well as what is recommended per our LPGs, and suggest courses of corrective action to avoid the potential for future ATF action.
5.) SiteVisit – A SiteVisit is an on-site audit, conducted by one of our Professionals, who measures a variety of different compliance elements within the operation in a spot check fashion, including: Form 4473 compliance, A&D Record Compliance, and Law Plus Guidelines Tally
Cost: $625/half-day, plus travel – no retainer necessary.
6.) DeepDIVe – Let Our Professionals Assess Your ATF Compliance Inspection Vulnerability. An FFLGuard “Drop In Visit evaluation” (DIVe) is a “house call” that we can perform unannounced and at our own discretion (with no cost to you), or that you can request and schedule (at an additional charge). Our Professional Services Branch – all former ATF Industry Operations Investigators with no less than 25 years of experience – will evaluate your potential vulnerabilities if an ATF inspection were to occur imminently.
A DeepDIVe is a multi-day, far-reaching compliance audit/inspection that is more comprehensive than what the ATF or any trade organization would perform. It includes all parts of our SiteVisit, but with an on-site visit from our Professionals for no less than two (2) full days, additional off-site work before and after the visit, an inventory review, a record-keeping assessment, plus an Attorney/Client privileged report and teleconference to detail our findings and suggested courses of action. The DeepDIVe is a mandatory first step for any HOT client.
Cost: $1,250 per day, with a two (2) day minimum, plus travel expenses.
