Entity Selection Advice
FFLGuard counsel will advise you with regard to forming and operating as a corporate entity (such as a limited liability company or a corporation), in order to negate potential personal liability (injury claims, contracts, debts, etc.) and help ensure your business’ viability and continuity.
FFLGuard counsel will oversee the entire ATF application process and advise you against pitfalls that could delay issuance of the FFL while keeping track of your application at ATF’s Federal Firearms Licensing Center.


Entity Corporate Governance Advice

FAQs
To get an FFL, you must have “business intent”, which can be satisfied through an LLC. While an LLC is not required, it can help establish a clear business intent, which could make the ATF more inclined to approve an FFL application.
Prohibited persons are disqualified from getting an FFL. These include:
- Anyone who has been convicted of a felony or any other crime, punishable by imprisonment for a term exceeding one year
- Anyone who under indictment for a felony or any other crime, punishable by imprisonment for a term exceeding one year
- Fugitives from Justice
- Unlawful Users or Addicts of Controlled Substances
- People who have been adjudicated as a mental defective or have been committed to any mental institution
- Illegal aliens
- People who have been discharged from the Armed Forces under dishonorable conditions;
- People who have renounced his or her United States citizenship;
- Anyone subject to a court order restraining the person from harassing, stalking, or threatening an intimate partner or child of the intimate partner
- People who have been convicted of a misdemeanor crime of domestic violence.
The entire FFL application process takes about 60 days from the time your correct application was first received at the Federal Firearms Licensing Center (FFLC).
