FAQs

What is the National Firearm Act?

First passed in 1934, the National Firearms Act (NFA) imposes taxes and registration requirements on gun ownership of certain firearms. Under the NFA a tax is imposed on the manufacture, import, and transfer of regulated firearms and registration with the ATF is required. 

What are NFA Firearms?

Guns that are NFA controlled include:

  • Machine guns
  • Short barreled rifles
  • Short barreled shotguns
  • Silencers
  • Destructive devices
  • Machine gun frames or receivers
  • Conversion kits for machine guns
  • Grenades
  • Any other weapon (AOW): pen guns, cane guns, etc.
What disqualifies you from owning NFA items?

Under federal law, the act does not allow prohibited persons to ship, transport, receive, or possess a firearm. 

Prohibited persons include:

  • Anyone who has been convicted of a felony or any other crime, punishable by imprisonment for a term exceeding one year 
  • Fugitives from Justice 
  • Unlawful Users or Addicts of Controlled Substances
  • People who have been adjudicated as a mental defective or have been committed to any mental institution
  • Anyone who under indictment for a felony or any other crime, punishable by imprisonment for a term exceeding one year 
  • Illegal aliens
  • People who have been discharged from the Armed Forces under dishonorable conditions
  • People who have renounced their United States citizenship
  • Anyone subject to a court order restraining the person from harassing, stalking, or threatening an intimate partner or child of the intimate partner
  • People who have been convicted of a misdemeanor crime of domestic violence
