FAQs
First passed in 1934, the National Firearms Act (NFA) imposes taxes and registration requirements on gun ownership of certain firearms. Under the NFA a tax is imposed on the manufacture, import, and transfer of regulated firearms and registration with the ATF is required.
Guns that are NFA controlled include:
- Machine guns
- Short barreled rifles
- Short barreled shotguns
- Silencers
- Destructive devices
- Machine gun frames or receivers
- Conversion kits for machine guns
- Grenades
- Any other weapon (AOW): pen guns, cane guns, etc.
Under federal law, the act does not allow prohibited persons to ship, transport, receive, or possess a firearm.
Prohibited persons include:
- Anyone who has been convicted of a felony or any other crime, punishable by imprisonment for a term exceeding one year
- Fugitives from Justice
- Unlawful Users or Addicts of Controlled Substances
- People who have been adjudicated as a mental defective or have been committed to any mental institution
- Anyone who under indictment for a felony or any other crime, punishable by imprisonment for a term exceeding one year
- Illegal aliens
- People who have been discharged from the Armed Forces under dishonorable conditions
- People who have renounced their United States citizenship
- Anyone subject to a court order restraining the person from harassing, stalking, or threatening an intimate partner or child of the intimate partner
- People who have been convicted of a misdemeanor crime of domestic violence
