PRIVATE – Royal Loan

posted on January 18, 2019

Q: Client has a customer who they dealt with over the course of a couple of years. The customer was in the military, and his country of origin is Ghana. The customer attempted to secretly ship the firearms he purchased from client to Ghana in cereal boxes, but was caught and is facing legal action by the U.S. Military. The customer stated that he was following instructions that he received from client, which client denies. The military lawyers contacted client a couple of months ago and asked a few questions, and client ensured them at that time that they did not and would not have given the customer any such instructions. Client did not hear anything further until today, when the military lawyers called again, requesting to speak with the employee that the client said he spoke with. The employee cooperated with the lawyers fully, but began to feel during the conversation that the lawyers were interrogating him, and became increasingly uncomfortable with their line of questioning. The lawyers have requested that the employee testify in court on September 25*, but have not sent a subpoena. They have also requested records relating to the disposition of the firearms in question. Client needs to know how to proceed. (*Note: the employee’s wife is scheduled to give birth on September 25.)
