NICS – NICS Deny

Q: WE HAD A CUSTOMER BRING A FIREARM IN FOR REPAIR THAT HAD TO BE SENT BACK TO THE FACTORY FOR SERVICE. THE FIREARM WAS TRANSFERRED TO BROWNING UNDER OUR FFL LICENSE IN FEBRUARY 2014. THE FIREARM STAYED AT BROWNING UNTIL JULY 2015 UNDERGOING FACTORY REPAIR. DURING THIS SAME TIME FRAME, OUR BUSINESS WAS RESTRUCTURED UNDER NEW OWNERSHIP, (SAME FAMILY, DIFFERENT MEMBER AS PRESIDENT), AND A NEW FFL WAS STARTED. WHEN THIS FIREARM RETURNED FROM FACTORY SERVICE, SINCE IT HAD BEEN SENT IN UNDER ONE FFL BUT WE NOW HAD TO RE-AQUIRE UNDER A NEW FFL, WE DID A 4473 WHEN THE CUSTOMER CAME IN TO RETRIEVE HIS FIREARM.  HE WAS A “DENY” ON THE NICS CHECK; WE WOULD NOT RELINQUISH THE FIREARM WHICH IS STILL HERE. WHAT SHOULD WE DO NOW?
