Q: Last week, a man won one of our gunbroker auctions and we shipped the pistol to his FFL in his state of Georgia. We then received a call from the customer that he was a DENY from NICS when his gunshop did the background check. He has paperwork confirming a pardon from a felony in 1976 (was shown to his shop prior to the background check), also he has a CHL in that state. Nonetheless he was denied and wants us to send the pistol to another FFL for him. What is your recommendation? I think that we really should either hold the pistol for him until he goes through the appropriate voluntary appeal process with the FBI OR just simply refund his money and explain to him that since we know he was denied, we cannot ship to another FFL. Just not sure how to handle this with the customer since we have never had anything like this happen before.
