NFA – Transfer to Individual or Trust Instructions

posted on January 18, 2019

Q: It has been brought to our attention that we may be processing NFA NICS checks incorrectly. When we first received our SOT we had a member of FFLGuard come in to the shop and explain how we were to process an NFA transaction. Today we have followed the NFA NICS Check process as follows: The purchaser (be it an individual or a Trust, Trustee) once the form 4 and approved stamp is returned to us fills out the information on the 4473, signs and dates we complete our portion including type, drives I.D. # , Manufacturer, Serial Number, Caliber, Shop Address and FFL Number, as well as marking box 22 (20) on the 4473. We have been informed that following that process for an Individual is correct but, that we are to run the NICS check and get a proceed for a Trustee on a Trust. After reviewing the instructions on the 4473 form it makes no mention how to handle Trustees in the exception paragraph. Please provide the correct process for both Individual and Trust 4473 processing. As well as how to correct any error made by processing the forms as described above.
