Q: We are an FFL in NJ and a local Law Enforcement Agency wanted to use us as their FFL to transfer NFA items to another local Law Enforcement Agency. The transfer was approved by the state who told the Agency to make the transfer at an FFL and fill out the required ATF Form 5, however the ATF instructed us not to fill out the form. Instead, the ATF informed us that the Agency requesting the transfer was responsible for filling out the required Form 5 and did not need an FFL to facilitate this type of transfer. We took the ATF’s advice and did not facilitate the transfer. Needless to say, we had a dissatisfied customer. What is the procedure for facilitating a transfer of NFA items?
