Q: We had a trustee trying to pick up a silencer who was denied. He was a bit angry – he wanted his wife, who is the settlor, to do the 4473 because all the guns go in her name. We are a PICS state and I didn’t know how to instruct him for a NICS challenge and in the course of chatting I asked if he had ever been arrested. He said no but he was in court once, 39 years ago, and that’s why he can’t own a gun and all the guns are in his wife’s name. I told him those things don’t expire and he needs to contact an attorney. I asked the wife if there are guns in the house – yes there are. This is a silencer shop transfer. If someone else on the trust does a 4473 and background check, isn’t that a straw purchase? Any suggestions?
