NFA – Prohibited Person Trustee

posted on January 18, 2019

Q: NFA question: A background check was done on a trustee to pick up a stamp/suppressor. He was “delayed’, “open” four days later, Suppressor transferred 6 days later, then NICS “deny” 8 days later. I called the trustee and was able to get the suppressor back into our possession and faxed the 4473 to ATF and NICS was notified appropriately. My question is this: He is now in the process of getting himself taken out of the trust until he clears up his “deny”, in the meantime when another trustee brings an updated copy of the trust (without him in it), do I have to re-submit a form 4, or can the existing stamp still be used but with the background check of one of the other trustees? Do I have to notify NFA Branch in any way? Does the “trust” need to be updated with the NFA Branch? I just want to make sure that once he is removed from the trust, that we can still transfer the suppressor to someone else on the trust?
