NFA – New Licensee Acquiring Prior Business

Q: An employee is in the process of buying the store from the current owner. One of the topics that came up in our discussions with him was a new FFL in his name. He has applied for a type 01 FFL and a SOT and is waiting for approval. He questioned us as to whether this is the right type of FFL for his store as he rents full auto guns on his range. He said the store has had a hard time getting a law enforcement officers to sign off causing very long lead-times for rental gun purchases. This confused us as we thought that if he is bringing a gun into the store for range rental he could just order it from us and a completed form 3 is sent with the gun. If the gun stays in the store for rental we thought there is no need for a LEO signature.( unless he sells it?) Could this be a TX law? Are the rules different for rental guns?
