NFA – Denied Silencer Transfer to Trust

posted on January 18, 2019

Q: I have a customer who gets Denied regularly on his purchases due to Identity Theft. In the past, he has always had his denials overturned through the NICS appeals process. Last year, this customer purchased three suppressors through a trust from SilencerShop.com and we received all of his tax stamps (2 last week – 1 Today). When this customer came in last week, we ran a NICS check on the transfer on 2 of the 3 suppressors – which was delayed and later denied. Rather than going back through the lengthy NICS appeals process, He asked if his wife can pick up the items – Who is also a trustee on the trust. Since a Trust technically owns the items – can another member of the Trust pick them up without being considered a straw purchase? If not, What are their options? The ATF has them registered to their address. If I am not able to make the transfer, what am I required to do regarding the three suppressors in my safe?
