Miscellaneous – Non-licensee Sends Gun to Manufacturer

Q: Customer of ours bought a Ruger SR 762 rifle from us and he had problems with his rifle, he is sending the rifle to Ruger for warranty and Ruger decided to give him a brand new rifle, and he has been told that we need to receive his rifle and transfer to him again, Well, we have dealt with these kind of issues before and our understanding was in warranty issues when manufacturer decides to exchange the product FFL shouldn’t be involved in this transaction, customer should be receiving the exchanged rifle at their house.

With this specific customer, his mom bought this rifle and gave it to him as a gift, later on, a few months later, we have found out that he can’t apply for a background check due to some medications he taking and he is in TBI’s radar and they will decline his the transactions, so we do not wanna get involved in any transaction that could be considered straw purchase. Since we are going to be receiving the rifle, he told us that he is going to bring his mom to fill out the paperwork (4473), I explained the process but yet wanted to ask your opinion, would you guys please inform us how to handle this situation?
