Misc. – Nonimmigrant Alien Firearm Rental

posted on January 18, 2019

Q: We have a few questions about renting of handguns and ammunition to non immigrant aliens. It’s our understanding that individuals coming to the US, under the VISA waiver program (VWP) are allowed with no questions asked and individuals here on VISA have restrictions. Question 1: Clarify our understanding that the above is correct. Question 2: Assuming that the above is correct, how can we best validate that the individual is a part of the VWP or is here on a VISA, i.e would the passport have that information or would we need some other documentation? We want a definitive way to document this information. For VISA’s (not on the VWP), it is our understanding that a hunting license is valid documentation. Question 3: (just for curiosity sake, not that we are going to do this): Would it be legal to sale a firearm to an individual under the VWP?
