Licensee – Non-Immigrant Alien Policy

Q: I have a question regarding the transfer of a firearm to a non-immigrant visa holder. This potential customer has been in the USA on a type O1 visa for 10 years. He is working with the state of Florida to obtain a Hunting license to hunt migratory birds this year. He would like to purchase a shotgun and a pistol from us once he has the hunting license. Is there any restriction as to type of firearm he can be transferred after he has qualified under exceptions 18 U.S.C. 922(y)(2)? It is a type O-1A that is good for an initial 3 years and indefinite extensions 1 year at a time with USCIS determinations. He has a I-94 admission number for block 13 of form 4473. As well as when running the NICS background check. Would that not ensure the visa was valid at this time?
