Licensee – Mental Institution

posted on January 18, 2019

Q: A guest came in today to place a pistol on layaway. I asked the guest to review the 4473 to ensure that she met the criteria to legally own a firearm. In that, she had a question about question 11f. – “Have you ever been adjudicated mentally defective OR have you ever been committed to a mental institution?” The guest, a veteran, was diagnosed with PTSD in the military in 2007. She was medically retired for a different injury. She is now on Social Security Disability for PTSD and is on medication. In August of 2013 she voluntarily checked herself in to the VA for Mental Health Treatment. She stayed for approximately 1.5 weeks and then checked herself out due to feeling unsafe in that environment (she was being sexually harassed by other patients and was unable to lock her room at night). Would this voluntary check in and check out of the VA Mental Heath treatment facility disqualify her / prevent us from making the transfer to her?
