Licensee – Employee with Prohibited Status

Q: We can’t find the criteria the ATF uses in considering if an employee is a prohibited person from handling firearm transactions. We have an employee that has two (2) Class B Misdemeanors for driving while intoxicated one in May 2011 and another in October 2013. These are the only violations or issue we have found in their background check. Would this person be considered a prohibited person?
