Q: We have a customer who has left his firearm for repair for over 30 days and now wants to pick it up. Our internal control in these situations is that, before releasing the firearm, we ask the customer to fill out a 4473 and perform a NICS background check. The customer answered “yes” to question 11i (domestic violence). We stopped the transaction at this point. The customer has openly admitted to having a felony conviction of Domestic Violence however he has also stated that he owns several firearms and is only prevented from purchasing additional ones but is not barred from possession. The customer’s wife wants to come in and pick up the firearm later today after passing her own 4473. Can we knowingly transfer the firearm to her when we know that she will give it to him and that they reside in the same home?
