CA – BB Guns

posted on January 18, 2019

Q: There is one bill that Gov Brown signed that we are a little unclear on the letter or intent of the law. SB-199 Re: BB devices Effective date 1/1/2016 Section 3, 16700 a, b Definition of “imitation firearm” goes back and forth as to what constitutes an “imitation firearm” and then whether or not something is exempt and why. At one point it says “substantially similar in coloration and overall appearance to an existing firearm as to lead a reasonable person to perceive that the device is a firearm.” But then later says “a BB device” is exempt. And in another place, over 6mm in diameter is not regulated, and in another place 8mm is regulated. And then in another place, if you put “adhesive bands” (I guess this means tape) that is fluorescent in color and at least 2 cm’s in width, wrapped around four areas on the device. And then of course their are exemptions for devices that have crazy colors or are clear. This law is written so poorly, I really don’t know what is, or is not exempt. But essentially, I am trying to decide what WILL be legal to sell come 2016. I don’t think the industry is going to make a bunch of orange pellet guns just for Cali!
