Q: We are working with a client where there are sales to a private company providing security at nuclear facilities. The security company makes purchases of firearms from a FFL (client included) and our understanding is that the security company (person under GCA) must purchase handguns (actual order and purchase documents) from an office that is located in the same state as the FFL. The purchase cannot be made from an office in a different state. This is unclear to us and we need clarification. We have a similar pending question below in black as the law references corporations simply maintaining an office in another state. The other question we believe is more clear and the answer is that individual security personnel even if under a company government contract are not police officers and cannot purchase firearms under the LE exemption. The firearms related to these questions are all GCA handguns. The similar pending question concerns the permanent assignment of firearms to security personnel that reside in a state where there is a business office but not the FFL location, however in this instance the purchaser (security company) is not a FFL.
